The law as it is written uses the term "In possession of". Dead or alive, if it's on your boat, you are in possession of it. In this particular case, he made the mistake of calling the NMFS. That may also save his ass in a court of law as he was not intentionally trying to catch the fish in his net ...

If that was your legal way of fishing and you hauled in a great white of any size that was now dead, you have two choices. Say nothing and dump it overboard, or bring it in and get arrested for being "in possession of" an endangered species. If it's still alive, pissed and tearing up your nets, seve...

In order to have good design, you have to be able to recognize bad design, and not allow it! I like my Striped Bass, but.... Seems like two guys braved that treacherous inlet in small boats alone and lost heir boats but thankfully, not their lives. If there IS a history with Cummins servicing or parts, your engine serial numbers should get them.
If the "older" than 1998 has a recent survey, you should be able to get a loan for it. You'll need a recent survey in order to get insurance if you buy it anyway.

The first 38's were built on a scaled up 31 hull. They were real Battlewagons. I suspect whatever happened between Bertram/Hunt/Napier revolved around the extension of that original hull design. If the boots are still on the wires, try pushing them over the terminals in a heated environment (heat gun on low or hair dryer) using some sort of lubricant. The liquid tape works well but is not a simple removal when that becomes necessary.

This year has been somewhat unusual. People caught big Threshers inshore when Bass fishing with Bunkers. My theory is they have less baitfish to eat so they're coming inshore to find food. Take everything with the big nets and the predators have to adapt to survive.
